Health Care Directive Guardian

Just as it is important to name a Power of Attorney for your finances, it is also important to name an agent to make your decisions regarding your health and your person. In fact, if you do not have a Health Care Directive in place you often need to go through the costly court process of a Guardianship. A Guardianship is a useful tool when necessary. However, by naming a health care agent yourself the court does not need to name one for you through a Guardianship proceeding. Planning ahead will save you time, money and you will be deciding who your agent is-not the courts.

When you are choosing a Health Care Agent is important to choose someone who is trustworthy, an advocate, shares your values, is responsible and is in close proximity to you. Make sure that in addition to naming your agent, you name a substitute agent. Often times one person will be unable or unavailable to meet your needs. It is always important to have back up.

Always discuss your wishes in detail with your Health Care agent. These difficult conversations can make future challenging situations less problematic. Sometimes clients will choose an agent who does not share their own health care views. This can work as long as the person you choose advocates for YOUR wishes; not their own.
